These Tokenize Exchange Terms of Use is entered into between you (hereinafter referred to as “you” or “your”) and Tokenize Exchange operators. By accessing, downloading, using or clicking on “I agree” to accept any Tokenize Exchange Services provided by Tokenize Exchange, you agree that you have read, understood and accepted all of the terms and conditions stipulated in these Terms of Use as well as our Privacy Policy.

Tokenize Exchange refers to an ecosystem comprising Tokenize Exchange websites.
Tokenize Exchange Accounts refer to the foundational virtual accounts.
Tokenize Exchange Operators refer to all parties that run Tokenize Exchange.
Tokenize Exchange Services refer to various services provided.
Digital Currencies refer to encrypted or digital tokens.
Fiat Trading refers to spot transactions in fiat.

II. General Provisions

1. About These Terms
These Terms constitute a legal agreement. Tokenize Exchange reserves the right to change or modify these Terms.

2. Prohibition of Use
BY ACCESSING AND USING Tokenize Exchange SERVICES, YOU REPRESENT AND WARRANT THAT YOU HAVE NOT BEEN INCLUDED IN ANY TRADE EMBARGOES OR ECONOMIC SANCTIONS LIST.

3. Tokenize Exchange Account Registration
All Users must apply for a Tokenize Exchange Account before using Tokenize Exchange Services. Tokenize Exchange may refuse, in its discretion, to open a Tokenize Exchange Account for you.

III. Tokenize Exchange Services

Upon completion of the registration and identity verification for your Tokenize Exchange Account, you may use various Tokenize Exchange Services, including but not limited to:

Crypto-to-crypto Trading: Spot trading on Tokenize Exchange in accordance with the provisions of these Terms.
Futures Trading: To conduct Futures Trading, you must conclude with Tokenize Exchange a separate Futures Service Agreement.
Options Trading: Requires understanding of high risks and options service agreements.
Margin Trading: Margin Service Terms of Use must be agreed upon.
Staking & POS: Tokenize Exchange offers services to reward users who hold Digital Currencies.

IV. Liabilities

1. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, Tokenize Exchange SERVICES, MATERIALS AND PRODUCTS ARE OFFERED “AS IS” AND “AS AVAILABLE”.

2. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Tokenize Exchange OR ITS AFFILIATES BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.

V. Resolving Disputes

Notice of Claim and internal dispute resolution required before arbitration.
Arbitration will be individual, governed by relevant rules.
Class Action Waiver applies; arbitration is individual only.
